Bester Pushes for State Records in Escape Trial

Convicted rapist and fugitive Thabo Bester has launched a fresh legal battle to obtain sensitive communication records and documents from senior government offices, arguing they are crucial to preparing his defence in his long-delayed prison escape case.

Bester has filed an access-to-information application in the High Court in Pretoria, seeking mobile phone records belonging to International Relations and Cooperation Minister Ronald Lamola, as well as confidential material held by the Presidency and Crime Intelligence. He claims these records will help him probe alleged state involvement, communication patterns, and investigative conduct linked to his dramatic 2022 escape from the Mangaung Correctional Centre.

Bester and his co-accused made a brief appearance in the Bloemfontein High Court on Friday for pre-trial proceedings. He has also demanded access to a laptop, the unfreezing of his bank accounts, and further documents he argues the State is unlawfully withholding. According to his application, the information is necessary for him to exercise his constitutional right to prepare a full and fair defence.

The trial has faced repeated delays due to parallel litigation. In September, the State informed the Constitutional Court that proceedings could only start after the apex court rules on co-accused Dr Nandipha Magudumana’s pending application.

The matter returns to court on 18 March for further case management, with trial dates set for 20 July and 18 September. Should his latest bid fail, Bester will be required to proceed without the classified documents he says are essential — signalling yet another high-profile legal clash in a saga that continues to grip South Africans.
