Magudumana’s Deportation Appeal Dismissed by SCA

On 16 May 2025, the Supreme Court of Appeal (SCA) dismissed Dr. Nandipha Magudumana’s appeal to have her arrest and deportation from Tanzania declared unlawful. The court’s decision upholds the earlier ruling by the Free State High Court, which found her 2023 return to South Africa to be lawful.

Magudumana, along with her partner, convicted murderer and rapist Thabo Bester, was apprehended in Arusha, Tanzania, in April 2023 after fleeing South Africa. She faces 38 charges, including fraud, corruption, money laundering, assisting an inmate to escape, violation of a corpse, arson, and defeating the ends of justice.

The National Prosecuting Authority (NPA) welcomed the SCA’s decision, stating that it clears the path for the trial to proceed without further delay. The trial is scheduled to take place from 21 July to 19 September 2025 in the Free State High Court in Bloemfontein.

The NPA emphasized its commitment to ensuring that justice is served and that the legal process is carried out transparently, given the serious nature of the alleged crimes and their impact on the rule of law and the victims involved.

This ruling marks a significant development in the high-profile case, allowing the prosecution to move forward with the trial proceedings as planned.
